1. Acceptance of Terms

By accessing or using RoofEstimate at roofestimate.pro (the "Site") or any associated services, you confirm that you are at least 18 years of age, have read these Terms, and agree to be bound by them. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

RoofEstimate is an online lead generation and contractor-matching marketplace that connects homeowners seeking roofing services with licensed roofing contractors. We do not perform roofing services ourselves. We provide a technology platform that facilitates introductions between homeowners and contractors.

3. Marketplace Nature

RoofEstimate is a marketplace, not a roofing company. We do not employ roofing contractors. Contractors in our network are independent third parties who have agreed to our contractor participation standards. We make no warranty regarding the quality, workmanship, or licensing of any specific contractor.

All contracts for roofing services are between the homeowner and the contractor directly. RoofEstimate is not a party to any work agreement, and we bear no responsibility for the quality of work performed, disputes arising from contractor performance, or any damages resulting from contractor services.

4. User Obligations

By using the Site, you agree to:

• Provide accurate, complete, and current information in all forms
• Not submit fraudulent, duplicate, or test leads
• Not use automated tools to submit forms or scrape the Site
• Not impersonate any person or entity
• Not interfere with the operation of the Site or its infrastructure
• Comply with all applicable laws and regulations

5. TCPA & Communications Consent

By submitting any form on this Site, you expressly consent, pursuant to the Telephone Consumer Protection Act (47 U.S.C. § 227) and applicable state laws, to receive marketing and informational communications from RoofEstimate and/or contractors in its network, including via: (i) telephone calls to your landline or mobile phone using an automated telephone dialing system or artificial or prerecorded voice messages; (ii) SMS/text messages; and (iii) email.

You understand and agree that: (a) your consent is not a condition of any purchase; (b) you may opt out at any time by replying STOP to any SMS or calling us at (800) 766-3669; (c) message and data rates may apply.

6. Contractor Terms

Contractors who participate in the RoofEstimate network agree to a separate Contractor Participation Agreement. Contractors must maintain valid state licensing and insurance throughout their participation. RoofEstimate reserves the right to remove any contractor from the network at any time for any reason, including licensing violations, consumer complaints, or fraud.

7. Estimates and Pricing

Cost ranges and estimates displayed on the Site are general market averages for informational purposes only. Actual costs will vary significantly based on your specific project, location, materials, and market conditions. No information on this Site constitutes a binding estimate or guarantee of any particular price.

8. Intellectual Property

The Site and its content — including text, graphics, logos, images, and software — are owned by or licensed to RoofEstimate and are protected by United States and international intellectual property laws. You may not reproduce, modify, distribute, or create derivative works without our express written permission.

9. Privacy

Your use of the Site is subject to our Privacy Policy, which is incorporated by reference into these Terms. Our Privacy Policy governs how we collect, use, and share your personal information.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND CONTRACTOR MATCHES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ROOFESTIMATE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOFESTIMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO US IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless RoofEstimate and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You consent to exclusive jurisdiction and venue in the state and federal courts located in Travis County, Texas.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Site shall first be submitted to informal negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration under the American Arbitration Association's Commercial Arbitration Rules. YOU AND ROOFESTIMATE WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS.

15. Termination

We reserve the right to terminate or suspend your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, contractors, or our business interests.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date. Continued use of the Site after any modification constitutes acceptance of the updated Terms.
